Welcome to Senior Active Minds. By accessing our website, purchasing our products, or subscribing to our software applications (“Apps”), you agree to comply with and be bound by the following terms and policies. Please read them carefully.
1. Intellectual Property & Copyright Notice
All software applications, source code, designs, user interfaces, graphics, text, logos, and materials provided on this website and within our apps are the exclusive property of Senior Active Minds.
- Prohibited Use & Seat Licensing: You are granted a limited, non-exclusive, non-transferable license based on the number of user seats you purchase. Each subscription seat grants access for a single user. Sharing login credentials among multiple staff members beyond your purchased seat allocation is strictly prohibited. Furthermore, each individual seat login is restricted to a single active session at a time; attempting to log into the same account simultaneously from multiple devices or locations will not work and may result in session termination. You are also strictly prohibited from copying, modifying, reverse-engineering, decompiling, redistributing, leasing, or reselling any part of our apps or intellectual property to third parties.
2. Artificial Intelligence (AI) Disclosure
Certain images, visual graphics, or content features utilized within our apps and website may be generated, enhanced, or assisted by Artificial Intelligence (AI) technologies. These assets are curated to provide engaging content for your residents while remaining subject to our overall intellectual property ownership.
3. Subscription Terms, Cancellations & Refunds
Our services are billed on a recurring subscription basis tailored for nursing homes and senior care facilities.
- No Refunds: All subscription fees, initial payments, and recurring charges are non-refundable. Once a billing cycle has begun, refunds will not be issued for partial or unused periods.
- Cancellation Policy: You may cancel your subscription at your convenience through your account settings or by contacting us directly at info@senioractiveminds.com.
- Access Upon Cancellation: If you choose to cancel, your subscription will remain fully active until the end of your current paid billing period (the end of the active month). Your access to the apps will then be disconnected at the conclusion of that paid term, and no further charges will occur.
4. Limitation of Liability & Facility Responsibility
Senior Active Minds provides software applications for recreational and engagement purposes in senior living environments.
- Technical Environment: We are not responsible for internet connectivity failures, hardware malfunctions, local network issues, or device compatibility problems at your facility.
- User Content: Users assume sole and absolute liability for any custom content, text, or images uploaded or created within the application. Senior Active Minds accepts no liability whatsoever for any such content, including images or information regarding living or recently deceased individuals.
- Liability Cap: To the maximum extent permitted by law, Senior Active Minds shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our applications.
5. Governing Law
These terms shall be governed by and construed in accordance with the laws of Ireland, and any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of Ireland.
